Police Reports: What If the Report Gets Things Wrong?

Many times important details in police reports are simply wrong. They can be misconstrued to the point where they are inaccurate and even unfair. It is crucial to understand that police incident reports are not evidence. Police reports are written with the principal goal of making you seem guilty of a crime. They are not and are not designed to be an impartial analysis of the scene. They are often not a fair depiction of key events and are never a fair and thorough assessment of all the stories told by all the witnesses.
They are typically prepared, by a police officer, after the officer has decided to arrest you for a crime. Police can only arrest you when they have probable cause to believe you have committed a crime. It certainly stands to reason and ought to be expected that a police incident report written after the arrest will be written with the aim of justifying the arrest.
Whenever there is an arrest made, the entire purpose of the police reports is to reinforce, document, and identify the evidence the officer deems sufficient to merit your arrest and further to support that decision to arrest you. It is exceedingly rare for a post-arrest police incident report to be written by an arresting officer with anything other than your guilt in mind.
It is not a fair process, but it is certainly understandable. It makes definite sense from the perspective of the arresting officer. If the officer has decided to arrest you, it is because he has formed the opinion that you are guilty of some criminal offense. If he thinks you are guilty his report will justify that. If the report is written in an effort to justify and support his opinion that you are in fact guilty, we should expect to see a biased account of the incident.
It does not matter and you should not worry about it in any great amount. Police reports are important because they reveal what the officer claims not because they are evidence and certainly not because they are right. Please remember the police report is NOT evidence.
